Indian railways - Regarding the usage of berths in day time

Sir,

I was travelling from Coimbatore to Trichy with my wife and kid of age 1 year(Mangalore express-6108) on 8th November 2010. Seat no 15 and 22 in S8 were alloted for us. 15 is lower berth(side) and 22 is upper berth. Since my kid feels sleepy I asked the lady who was sitting in the seat no 16 to go up, but that lady and her relative started to make conversation. And afterwards TTR told that there is a rule that the berth should be used from 9 PM onwards only.

If this is the rule in Indian Railways, then why you should mention SLEEPER CLASS, and SECOND SITTING CLASS. What is the difference between this?
And, also we are paying high to relax and travel, if it is not then why are you getting high pay?

My question is,

1) if a passenger starts from Mangalore by 11 AM and he/she is travelling, is that so he/she should not use the berth for sleep till 9 PM?

2) Why you are booking sleeper class in the day time train?

3) Example, Guruvayur express comes to Trichy at 2 PM and reaches Chennai by 9.30 PM, if a passenger must follow your rule, then does he/she should sleep only half an hour??

4) We can see, loaded advertisement boards in front and around why don't you STICK THE BILLS for such a hard rule?

5) We can hear in the station Happy journey, when a passenger travels after 6 AM and before 9 PM, it won't be a Happy journey for him, it will a Horrible journey.

If the rule can't be changed, kindly stick the bills in the compartment, so that the passenger will not argue each other.

If we wont sleep in our seat b/w 11.00am to 4.00pm,why we not sleep in our reservation seat on lower birth?

THE SAME OCCURANCE WITH ME HOWEVER I AM ILL AND I WAS NOT ABLE TO SLEEP IN PAWAN EXPRESS IN 3 AC BIRTH NO B1 15 SO RAILWAY SHOULD CHANGE THE RULES.

yes , i like this complaint, because of , i was travelling with my wife , two kids , one is 6th yrs,another 2.5yrs , sleeper class coach no. S-5 berth no.12 Lower Berth, 10 Middle Berth, 15 Side Lower , ujjain jn. to kota jn. & train deparch at ujjain 5.35, ariival time in kota 10.30 dated on 05/08/2013, since my kids feels sleepy,i told the man who was sitting on berth 12,to go up but man would be discuss to me. when TTR come iwas complained to him , but told me that there is a rule that berth should be used from 9.00pm onwords only, he inserted me, that i will talk to govt. make a railway reservation rule accordding to you.
Is it correct, there no difference sleeper class between sitting class , why i much than pay for sleeper class.

This is a good rule. It used to be mentioned near all the windows in every compartment right under the chain.

Now for some reason they have removed it from being written but it's still a valid rule.

Berths are seats during the day. They become berths only between 9 PM and 6 AM. During the day they are supposed to be seats so that all the passengers can sit comfortably.

Otherwise, technically speaking the two people on the lower berths can sleep all day so where will the other passengers sit? On the roof?

Please note that it is very uncomfortable for people to sit on the upper berths, that's why everyone gets a seat to sit on the lower berths during day time. If you notice, the seat numbers (not berth numbers) are written inside the compartment which indicate the places allotted to every passenger to sit, not sleep.

If your kids were sleepy, you could have sent them on the vacant upper berths. Just because you happen to have lower berth reservations does mean that you can hog all the lower berth space and expect the other passengers to go to the roof.

Only, if the upper berth passenger goes up on his own accord to sleep, you can then use the lower berth to sleep which is otherwise meant to be used a sitting area during day-time.

Alternately, you can use the upper berths for sleeping if that passenger is sitting on the lower berth.

I strongly support this complaint and also request concerned authorities to make changes in the fares in day time trains i.e., without collecting the berth charges for day time trains.

I never heard such a rule, this should be informed to the public. Is this act true?
