Dear Shri Dey,
I have received your notice as on date* signed by you as secretary but I don’t know when and how you- elected as secretary.As far I know there are no any notice on the notice board advising the flat owners regarding the election and its venue and date of election and astonished to see the dues falls due from G3 portion , also as you written in the notice, where 60% of maintenances are spend on that portion and we all from G4 portion flat owners see that all the repairs and maintenances are done on G3 portion only because the funds* are in the hands of G3 flat owners. Moreover, generator was not in used in day since January 2008 but for one person of G3 the same generator was regularly used in day time when his / her relative comes to his / her flat, please clarify. We have purchased the flat after verifying all the facilities and for it I have paid my share for the cost of lift, water connection, generator and pipes & fittings etc. I paid it for the facilities to be availed for all and not for only one person. Moreover you had decorated the post of President and Secretary of this committee and did some good works for the whole apartment sometimes but this works were not acceptable for the flat owners of G3 portion and they openly declared you as a BRAINLESS PERSON which you also know it and those persons compelled you so many times to gave your resignations, the copy of your several resignation letters are kept by me for my necessary utilisation, when required. The persons of G3 wanted to utilized the whole funds for their portion only, after payments of Security, general electric bills and lifts etc for which you some times opposed. At last they succeeded to take your resignation. and after your resignation the persons are selecting for the post from the non-flat* owners, you may say it they are hiring the persons of their choice who will do the job as the persons of G3 portion wish and there are so many evidences of the hired* portfolio holders did the works for G3 portion only, which you must accept that the post will be hold by the flat owners only and not the power of authority holders*, Where there are so many flat owners in the apartment to be elected for the post ,then why the G3 flat owners selected a power of authority holders*? Why they compelled you to resign from the post several* times? Yet I accept you as secretary because you are not brainless person, in my opinion, rather I think those persons are brainless who told you brainless and they remained open -so many examples of their misdeeds and highhandedness resulting collapsed of the committee’s fund*but I still remain unaware who is the President and Treasurer of the committee because of non elected treasurer* I am unable to pay the maintenance amount which I regularly paid in the 1st* day of the month- so I require a copy of the minute of the meeting which elected you & others portfolio holders of the committee or you may display it on the notice board..
Further it is learnt that you are the secretary of the Gangotri Flat Owners Association but I don’t know how and when “Gangotri Flat Owner’s Association†was formed. Being a flat owner I don’t know the facts. There are many example and proof of G3 person’s highhandedness are compiled by me and kept it for necessary action when times come.
Further, I again request you to please arrange for the good water as you did in G3 by installing submersible pump water taking funds from all* flat owners as you did it for G3 portion and request you for well maintenance of the whole apartment. If the funds collected from every months are not sufficient for well maintenance You please enhance the amount by calling a meeting for approval but every things should be in written with also in detail format- no hidden clause.
Please do to provide me the back records of meetings held, fund collected & spends etc along with all.

I recall my mail dated 11th December 2008 and which has been confirm by your acknowledgement I would like to inform you further that the few flat owners are still trying to disturbed us in many ways. Sometimes they disallowed the postman to use the lift to handover my registered mail/speed posts and so the postman returned the mails to senders -sometimes they took the mail from the couriers signed in falls names but not handed it over to us, sometimes they told the couriers/postman that we have shifted from here so it returned to the senders. They many times via many guards tried to disrespect and Insult us mostly my parents with top priority my Mother in many ways but was not succeeded .All the happenings have proof either by video graphed or recording the statements from the couriers and postman or some other matters for future reference proof as Most Believe a group involve if can’t be false-group involve are false or not the recording would proof-when we came to know it from any sources. You may examine it any time.
Furthers the other flat owner’s enmity with us due to that my father after retirement came here for permanent settlement on 26th January 2006 and he became cashier of the committee and found that many misappropriation of fund by the previous committee and pointed out to other members but astonishingly observed that the other members told my father that it is not lookout of the cashier so immediately my father resign from the committee. This is the main point of enmity. You may verify the old accounts book and committee register old one from the present committee to verify the truth of this letter. My father is a physically handicapped person both the knee has been replaced so he is not able to use ladder to 4th floor. To punished my father the committee intentionally broken the generator by not pouring the mobile in time though it was severally reminded by the duty guards and more than one year the generator was not repaired so my father stopped the payment of the maintenance from September 2008 along with the contaminated water no problem short out etc matters too -with written three notice to the Nagarik committee and copy of them to Local OC for necessary action but all in vain.
To punished us they used abusing word to my mother when objected and asked to clarify the word then in the name of meeting at about 9.30 P.M. on 11th October 2006 they call my father through duty guard Shri Chinto Haldar but father refused to attend the meeting without any previous notice so out of curiosity I went to ground floor and saw that not only male members but their wives, sons and daughters are standing in the meetings and as soon as I went there some Nitai Biswas jumped over me and began to beat me when I protested some Arup Biswas, Arindom Sengupta,Utsab Sengupta and other surrounded me and caught tightly so that other members like Ajit Sengupta,Arun Debroy can beat me without any defense from my side. Hearing the noise from the ground floor my parents and younger brother came down and they tried to free me from their clutches by force. All the happenings has an eye witness is the then duty guard, who has been sacked after the incidents and worn him not to disclose the facts to anyone but incidentally we have video graphed his few statement about the incidents of 11th October 2006.Then not succeeding to teach us lesson they immediately called the police. Some Mouli Das shouting at that time that snatch those two sons and killed them in the mob so nobody will be held responsible. At about 11.30 P.M. after two hours of incidents somebody knock my door when we open the door I saw that a A.S.I. with two constables are standing outside my door- we welcome them then the A.S.I told that some persons have lodge a complaint against us so they have no way but to take us to police station and promised to my parents not to do any harm to my sons because he told that his O.C.is very honest and we judged persons and he will make justice to us. My father allowed us to go police station. But when O.C releases us on personal bonds the other flat owners still trying to harm us. My father served the legal notice to all the participants of the incidents of 11th October 2006 then they immediately went to the local Nagarik Committee for rescue in turn the Nagarik Committee arrange a meeting on 8th April 2007 where some members of the Nagarik Committee threatened my father for dire consequences if he takes legal action but my father told to the committee that he will not withdrew the legal action but to withheld it for the time being. The committee advises my father to give separate letters informing these facts. But the committee took a sign in the registered of the committee stating that he withdraw the notice without any terms. Then my father watching the partiality of the committee he within a week served letters to all concerned persons informing the real facts and not unconditional withdraw of the legal notices. Moreover thrice Nagarik Committee had arranged meeting to threaten us in many ways, the matter copy which too had been reported to Local Police station in form of dairies but no result.
After that they have tried to harass us many ways and every incident had been diarized in the Sonarpur police station. Failing from all sides now the committee members are taking help from a renter to disturbed us and that is why I inform you few of incidents for justice. My parents already knocked the door of the HUMAN RIGHTS COMMISSION for Justice but failed.
