I Mr. Dingankar Owner of flat 204 on 2nd floor in a Co-op H.S.G Society in Mumbai had complain for the unauthorized box grill weather/rain(Tin patra) shade made to the enclosed balcony by the Owner of flat G/104 on the 1st floor below my flat. This is the weather/rain(Tin patra) shade made outside the bed room of 104 and it’s so big (it is above 3 feet in breadth/width) and which is also much more bigger in size than the actual weather shade’s/chhajja’s to other windows, due to which I myself & my family are facing too much problems like:
01. All the upper floor flats rubbish garbage etc accumulate on this shade
02. Water thrown from upper flats gives reverse splashes of dirty water which spoils our washed cloths resulting in too much problem for me & my family.
03. More over there is also an obstruction of view.
I had given complaint to the MCGM Asst Eng (Bldg & Factory) 'F' South ward on 30th Dec 2010, on my complaint they visited in our society & issued a letter dated 08/01/2011(FS/32423/BF) to the concerned party asking him to remove the same immediately failing which action deemed fit under MMC Act 1888 or MRTP Act 1966 will be taken.
After more than 2 months again after my repeated written complaint dated 11th Feb 2011 to Asst Engineer(Bldg & Fact), AMC & DMC Z II and on my complaint, I got reply from Asst Engineer (Bldg & Fact) dated 11/03/2011 (FS/039458/BF) stating that by the direction of DMC Z – II this is to inform that there is no logic in my complaint for removal of box grill & that my complaint can not be establish & no action is warranted & complaint is treated as close.
Sir, I want to know, if at all my complaint is illogical and incorrect then why the letter dated 08/01/2011 FS/32423/BF was issued from F/South Ward on my written complaint dated 30th Dec 2010 asking the concerned party to remove the same failing which action deemed fit under MMC Act 1888 or MRTP Act 1966 will be initiated.
