Property - Fraud being done by SmartCity,Tijara Builder

Dear Sir,

1) My brother and I had booked two plots 125 Sq yds each on 1-Dec-2012 in your SmartCity Tijara project and the corresponding Ledger numbers are SCDT00497 and SCDT00498 respectively.

2) The allotment letter was issued on 8-Jan 2013 and plot numbers allotted were B219 & B220 in the name of Manoj Kaushik and Sanjay Kaushik with Ref no ALTDN/00369/12-13 and ALTDN/00370/12-13 respectively. The Allotment letter states that “The possession of plot shall be delivered on or before November 2013’.

3) When we booked the plot it was told that project is bankable from ICICI Bank, PNB Bank and Gramin Bank but loan would be available once 40% payment is done.

4) We made the 40% of the payment as per the payment plan and last payment was done on 9th March 2013.

5) We called to Mr.Karian Pal at number 0********48 several times but there were no satisfactory responses on the bank loan as well as the project delivery. Every time we were told that Mr. Karian pal is busy in launching other project in Shahpura (Jaipur) and not looking into this project currently. Mr. Karian Pal did not even share the Fax no and the Director’s contact details ever despite various requests.

6) We dropped an email to Mr. Karian Pal on 30-Aug-2013 on email id (karian.pal@smartcitytijara.com and info@smartcitytijara.com) regarding the status of the project & the bank loan status. We got response on 2-Sep that bank will provide the loan within 15 days.

7) You sent out another demand letter for 15% payment which was received by us on 9-Sep-2013 despite knowing the fact that your project is not bankable. We sent out a rejection letter for this demand letter on 19th Sep as we were not able to make the payment by our own and project was not bankable to make the payment.

8) On 11-Sep-2013 I received an email from your side that Bank loan has been approved from PNB, ICICI and Gramin Bank but to process the loan you need my documents Form-16, ID Proof, Address proof, Bank statement, 3 years ITR etc.

9) On 11-Sep-2013, I replied to above email and asked for Bank approval letter so that I can approach to bank and talk about the loan directly. There is no point of giving these documents to builder as loan will be provided by bank and not the builder. You replied on the same day that Bank approval letter is not in office and would be provided by Mr. Karian Pal once he is back in 2-3 days from Shahpura (Jaipur) where he was launching another project.

10) I sent a reminder for Bank approval document on 19th Sep and follow up reminder on 23rd Sep 2013 but did not receive any response from your side till date.

11) I sent another email on 18th Oct seeking for Refund of amount deposited till date with interest rate which you charge for late payment to email ids karian.pal@smartcitytijara.com, info@smartcitytijara.com, satbir.singh@smartcitytijara.com but have not heard anything from you till date.

12) After missing several deadlines, after giving several false promises, we haven’t received any loan approval letter from your side till date.

13) Above points states that your project was never bankable when it was launched wherein it should have been bankable before booking. Neither you were ever interested in addressing the concerns. As per the allotment letter you were supposed to deliver the project in Nov 2013 which doesn’t seems to be possible as your property is not yet bankable.

14) This is my hard earned money that has been invested with the objective for a better future for me and my family. However the incidences of last few months and the conversation over the email, phone and non-approval of loan is a mental harassment for me and give indications that my money is stuck and I am on the verge of losing it.

15) I have tried my level best to reach you and sort out the issue but you were nowhere interested in sorting out the issue neither refunding my money.

16) This is my humble request to you to refund my money with the interest rate which you charge on late payment (1.5% per month as per allotment letter) along with Rs 200000 compensation for mental harassment.

Investing buying at tijara bhiwadi is a very big mistake....especially if you read the clauses of BBA you will see that its putting your hard earned money and buying houses in societies which the builder dsnt let rwa form in and hands over to maintence companies which are filled with very very unprofessionalpersons n in every way you end up not being an owner but just poor people made to pay over charges and absurd rulez forced by unlawful acts.

Have the society manager and builder people the right to come and simply break the grill? When we refuse to remove it after their wrong way of dealing with the issue?

They simply refuse to give in writing and are refusing to hear our plea.

Its not encroachment we havent touched or changed any wall of theirs. Someone please guide.

How to force them to give in writing?they r refusing.

They sent men to break and in between dad got very panicky n asked them to leave saying wil do fir as this is gundagardi....but can someone please tell me the right way that they can actually do it? Is this th way tht they can adopt ?

They say let us break from n we will break it from inside n if u dont we wil do it when you are there from outside....how can they legally have rights over our area our enclosure by a clause added in BBA .and even if so shouldnt there be a way like send written notice first give time n let the court decide wether grill demand by senior citizens is justified or not?

DOES BUILDER BUYER AGREEMENT ALLOWS A BUILDER FORCE THROUGH HIS SOCIETY MANAGER TO DO DEMOLITIONS OF VERTICAL SHED LESS NON ENCROACHMENT BOX GRILL IN OUR OWNED BOUGHT SPACE BALCONY ? My question is who approves one sided builder buyer agreements in corporation in government? Sometimes aged couple do errors and sign builder buyer agreement which is totally a slavery contract inspite of buying a house with their hard earned money. Can you tell me if by mistake a 75 yrs old man gets grill put up in his owned flat balcony by mistake dsnt knw tht he needs permission from maintenance secretary before and wants to keep it for his n his wifes security. Is builder buyer agreement ENUF TO COME BANG ON DOOR ENTER HIS HOUSE N BREAK IT or say will break from outside? Is it not gundagardi? N we say give legal notice we cant take it off after such unprofessional way..so that the court can see the agreement and the builder says simply says will not give in writing.....nor will send legal notice will just pressurize his society manager to harrass elders.....TELL ME WHICH DEPARTMENT OF YOURS ALLOWS N PERMITS SUCH BUILDERS to not even let A RWA FORM BEFORE 3 YEARS ETC .....which one of the department leys them go ahead with such clauses??BRASH SOCIETY MANAGER MR CHAUHAN AT managing BDI AMBARAM). After that in mornings same people get to watch your family your belongings and ofcourse YOU SHOULD STILL FEEL SAFE !! WHY? ....since at first opportunity the manager enjoys SHOWING OFF THAT NO MATTER U BOUGHT A HOUSE HERE U ARE OWNER EVEN IF THEIR SALARIES GIVEN BY YOUR MAINTENANCE MONEY STILL....THE very young immature persons like MR PANKAJ GIRI happily comes to team up with mr chauhan on conference and THREATENS THAT HE WILL ENTER HOUSE FORCIBLY TMMRW even if the matter is not of his DEPARTMENT!! ....Y? REST ASSURED AFTER SALE SERVICE ? FORGET IT !!I SPEAK OUT OF anger towards DISRESPECT TOWARDS MY ELDERS AND ME AS A WOMAN! REPENT BUYING . AND NOW SALES TEAM RUNSOFF UPON ME ASKING FOR BUY BACK POLICY MD hardly cared ensure reply to mails and pankaj says "I DNT CARE TO READ MAILS N THREATENS me as guided by mr chauhan"
There are multiple social grieveances at ground zero which only highlight the demeanor of various staff people.

All of you have colluded together and hatched a conspiracy against me and under the conspiracy, Mr. Sanjeet Singh Yadav Propieter of Jeet Properties Authorised dealer/Channel Partner of Smartcity Developer Private Limited, Opposite Kajaria Green, Alwar Bye pass,Bhiwadi-301019 approched me on 24.12.2012 and lured me by showing false,fabricated and attractive offer of plot under the false and fraudulent project of developing a colony in the name and style of "SMARTCITY" on the land owned by Smartcity Developers Private limited situated in the revenue estate of Village Tijara,Tehsil,Tijara,District Alwar (Rajasthan) and invited my client to attend pre- launching function organized by all of you at Smartcity Tijara.

In the function several false,fabricated and attractive offers for purchasing plots were presented i.e. initial Rate of land for Plot was declared @ Rs. 7900 per sq. yard but a special offer of 4% discount was given to lure the people fraudulently and the rate was fixed Rs.7600/- per sq.yard. for those who would book the plot on the spot on the same day by depositing advance payment of Rs.1,00,000/- with you.
By showing lucrative and attractive offer of plot fraudulently all of you have convenience me to book a plot of measuring 125 sq.yard in the said project, I have deposited an amount of Rs.1,00,000/- with you vide cheque No.437834 dated 24.10.2015 drawn on SBI,bhiwadi and further you told me to pay Rs.9,48,000/- in 8 instalments(first @10% second to sixth@15% seventh 10% and eight th @5% at the time of taking possession.

You have executed an agreement of sale with me on 5.3.2014 and plot no.B-102 having super area of approximately 1125sq. Feet in the project was allotted to me and accordingly I have deposit payment of Rs.5,21,000/- as ondate. (vide your payment receipt dated 24.10.2012, 21.12.2012,24.1.2013 and 5.3.2014).
You have never developed this plot till date even after expiry of more than stipulated time period according to the agreement dated 5.3.2014 nor resumed any communication with me. Regarding possession of said plot as well as you have shifted your office tijara to some unknown place and no information has been given about the addresses and of new office which is also a violation of terms of agreement, which shows your malafide and fraudulent intention.
Mr. Kiran Pal had been nominated by all of you for communication and interaction with customers in order to reply their quries thus I am trying to contact him since longtime on his telephone, emails and personally at the address provided by you but he is not available. All these acts and conducts committed at the parts of Mr. Kiran pal as well as others directors are showing the malicious and fraudulent intention of all of you.
I have also tried my best to meet several time to resolve this issue with Mr. sanjeet Yadav Proprietor Jeet Properties with my humble request to refund my money with the interest rate which you charge on late payment (1.5% per month as per allotment letter) along with Rs. 2,00,000 compensation for mental harassment.

After giving call,email,complaints they are still thinking that there,s nothing to do with the customer. All the judiciary,media administration is in their pocket. otherwise they must contact customer to resolve these issue on priority basis. All the directors enjoy their life and business without taking it serious.

All are requested to give their email id contact no. and address and share information about the action already taken and going to take. The advocate name address and court in which case is proceeding may also be communicated for speedy action.

I have booked plot of 125 sq. yard in ‘Smart city Developers’ Tijara distt. Alwar around 3-years back.
Against that we have made 40% payment. Also developer has issued us BUILDER BUYER AGREEMENTS.

Since last two year we are following with Mr. Satbir Yadav, one of promoter, Kiran Pal and also with Mr. Sanjeet Yadav- Jeet property, Bhiwadi, but we did not get any positive reply from his side. Even from since last one year he is not picking our phone calls to clear our queries or doubts.

Around one year back Mr. Satbeer Yadav told us all stories cursing, not getting approval from state govt. authorities etc. etc…. sorry for delay of project and assured to give possession of our plots soon.

Sir but now we are clueless, every time he is coming with lame excuse and now he stopped taking the calls. We fear that we have lost our hard earned money. It is more frustrating to me. Sir we applied looking at Satbeer Yadav as one of the promoter and thinking this man is GOD believing and will deliver the project as per the promise made.
We are seeking your help to intervene in the matter and bail us out from the position. It seem from the action that he has no fear of law and his only motive how to make the money at cost of public or by fraudulent behavior.
If you are not in position to help us please guide to whom should we contact.

They are big CHOR. Inspite of many FIRs police is not taking any action. Police is not interested in arresting these person, reason you may understand well. There are so many court cases also against these person but police is least bothered. If police want they can arrest within hours. Kiranpal is all time available at his house in Maseet village.

Smart city is a big fraud. There are many FIR lodged in Tijara police station. Proper action should be taken now with the intervention of court. All directors including - Satbir Singh, Atar Sign and Kiran pal are big fraud..

I am also the victim of smartcity fraud created by Kiran Pal and Satbir Singh. I am not sure whether all of you filed a different complaints against them or a combined complaint? Is there any action taken by Police, by Satbir/Kiranpal?
Is there any status of your legal proceedings?

This new project is also a fraud and this time they have created a new company: Smartcity Buildcon Private Limited. I request people to not invest in their projects. You will regret later.
