Under the Consumer Protection Act the following clauses are applicable to this present case:-

What Constitutes a Complaint

A complaint means any allegation in writing made by a complainant that-

An unfair trade practice or a restrictive trade practice has been adopted by any trader or service provider
The goods bought by him or agreed to be bought by him; suffer from one or more defects
A trader or service provider, as the case may be, has charged for the goods or for the service mentioned in the complaint a price in excess of the price fixed by or under any law for the time being in force or displayed on the goods or any package containing such goods or displayed on the price list exhibited by him by or under any law for the time being in force or agreed between the parties (YOUR ADVERTISED DISCOUNT IS APPLICABLE BY DEFAULT AS IT IS NOT AN ACQUIRE DISCOUNT COUPON ON PURCHASE OF ANY GOODS)
I will be filing the concerned complaint with the appropriate District Forum in Bangalore and MY PARTICULAR CASE WOULD INCLUDE ALL THE CLAUSES MENTIONED ABOVE look forward to meeting you there.

First of all I do not need your warm greetings anymore, nor do I believe
you are happy to help. It is a classic case of trying to frustrate the
attempts of an aggrieved customer to achieve a fair settlement. I have
placed the order online and therefore I do not wish to receive any phone
call from anyone.

Please learn the English language to comprehend the simple fact that I have
repeatedly made it clear that I do not wish to speak to anyone and this is
for the final time.

As you have been indulging in an unfair trade practice act the simple
solution is for you to send the refund of the unfair excessive profits that
you have made due to the unfair trade practice.

I want to know only one thing - If the advertised code of SUN50 was applied
would I have been provided the discount of 50% or not? I am sure it would
have going by the second order on which it did. Therefore as I had
repeatedly mentioned in my earlier emails the amicable solution would be
for me the receive the cheque in my name - I. Jaffer Mohammed Sait and you
could send it crossed if you so wish.

One more suggestion on your customer service - The thing that annoyed me
mostly was receiving so many SMS's saying that some member of your team
would get in touch with me to sort out the problem and NO ONE EVER DID.
Check with your records on the number of SMS's sent to my mobile number

Looking forward to an early closure of this extended agony.

Let me put your response in perspective:-

a) Your statement: "Price on any product is not constant and keeps on
changing from time to time" is not applicable in this present case as both
the products and prices are the same over the two orders placed.

b) Your statement: "in order 1201341318 you have applied the coupon code
as SUN50 so you have received the order on discounted price of 50%, whereas
in the order 1201323048, you have availed the discount amounted to Rs 450"

My comments:- Your statement clearly demonstrates that since the coupon
code SUN50 was not applied on order 1201323028 by me due to oversight you
stand to make unscrupulous profit of Rs 750.000 due to an innocent
oversight. In any event this coupon code has been advertised on your
website and therefore applicable by default and hence the discount of 50%
should also have been applied to the above referenced order. Clearly this
is a case of 'UNFAIR TRADE PRACTICE" and falls within the purview of the
Consumer Protection Act. I did deliberately place the second order, am not
a fool to order identical products the second time, just to obtain proof of
your deceit and unethical conduct.

I call upon you to refund the excess amount of Rs 750.00 (Indian Rupees
seven hundred and fifty only) within 15 days failing which I shall be
constrained to take recourse to all legal steps that would be available to
me. I am sure you will not want to be branded as a cheating,
deceitful, unscrupulous, unethical and an unfair trader looking to make
profits at your customer's costs.

3) Your statement: "Look forward to your acknowledgement and a mutual
association. We work round the clock to ensure our customers have what they
need."

Should I even comment on these empty statements and surely you need to
update on your morals and business ethics.
