I, Laishram Seityaswarai (Tenant) would like to file a legal complaint against my Landlord (Mr. Shetty) for not refunding my security deposit.
On July 1, 2011, I rented an apartment on 3rd Floor, 35/2, 3rd Cross, Laljinagar, Lakkasandra, Bangalore – 30, from Mr. V.K Shetty (Landlord) and gave him a security deposit of Rs.60, 000.00. Enclosed is the signed rental agreement. On first week of the May we were notified by the land lord and his son to move out as his son wants to occupy the same apartment (as he got married). After their notification to vacate the house (on May first week) we searched a new house and informed them we are ready to move out by the end of the month May itself (This being our 1st REMINDER to return the deposit amount if he wants the house to be vacated). At that point of time he (the landlord) was not in a position to return the deposit so asked us give him time till the end of June to arrange and refund the deposit.
2nd REMINDER: As agreed on first week of the month July, I went to the landlord again to get the deposit but he denied to return the same saying he DON’T have the money and cannot give it back until 20th of July.
On this 3rd incident, he (the landlord) even promised to our broker (Amir) that he will refund the whole deposit amount no matter what. So, we gave him this last chance to arrange the amount and agreed to give him this deadline and we started shifting to the new rented house.
4th incidence: on 20th of July we (myself along with the broker) went to collect the deposit but to our utterly dismay he refused to give us back the deposit giving lame excuses.
He still hasn’t given us back my deposit money inspite of numerous reminders.
We as per the agreed/signed rental agreement, which has expired one month back (June) want our deposit money so that we can give/deposit to the new rented house where we have shifted since last month on their (the landlord’s) notification to vacate the house.
Kindly look into this as we are due to pay our deposit to our new rented house. Thanking you for your time and consideration.
