Sub: Heating / Hanging / Headphone not working / Sold defected piece by seller - Completely Fraud

Dear All Concern

This is to inform your good self that I have purchased a New Black berry Q10 / EMI No. 35********37427 from M/s. Kalaniketan Gandhidham, Invoice no. 304 Dated: 16th June 2013 billed to Mr Paresh Shah / Mobile no. ********93. The piece was not functioning in proper manner & devices were also not working, please note below causes which faced while using new phone.

1) The Piece is generating heat / gets very hot while using,
2) again while talking on phone the piece gets hanged automatically after certain time.
3) Head phone is not functioning at all when we tried on very next day, since these problems should never come in new phone.

This problem started on very next day of purchashing; I even took the piece to the seller Kalaniketan Gandhidham, address: 1 & 2 plot no. 597, 12-C, Nr. Police Station, Gandhidham Kutch, Gujarat. I would like to inform you that there was no service center in Gandhidham since these years & was repeatedly giving us fake instructions that Blackberry is going to launch service center shortly, but there was no proper solution or no proper service to the piece. Further till service center gets launched they asked us to keep piece with us & will inform when service center is available in Gandhidham. So all this time there was no center & piece was lying without any use without any service.

I request you to kindly take up matter on urgent basis as this phone is of no use, I have even complained online on Blackberry site to support team but there was no feedback from blackberry team even. We have been cheated by selling defected piece / wrong instrument along with
fake instructions to keep waiting just to finish the guarantee period of piece, now its a high time we need a proper solution & we dont need this piece to be repaired or checked but need immediate replacement for this defected wrong piece been provided to us for which we have paid Rs. 43500/- with bill.

We either need an answer for such frauds how such defected piece are sold in the market & why service center are not available when required. Pls advise the solutions or what further legal actions should be taken against this for this defected piece which was sold out to us in absence of blackberry service centers.

At the moment, finally service center has just started & piece is lying recently with blackberry team since date: 14th Sept. 2013 & there is no solution so far. Kindly take up this matter to the HOD of Blackberry / Sales manager of india / gujarat region for proper solution, either instruct ur dealer to refund money or replace the piece which is lying with us in off condition since date of purchase.

Either we need a fresh piece from dealer or blackberry franchises or last option u can pressure up ur dealer to refund us our amount, or else we don't have any option but to go legally against dealer & also against Blackberry who is producing & launching defected pieces in market.
In case of absence of reply up to Wednesday 25th / Thursday 26th Sept., we will challenge the above factors / defects in court against this fraud against both - Blackberry & Dealer too who is selling defected piece.

Awaiting yours prompt reply with the solution of replacement or either refund of money.
