CREATIVE CREATIVE CONSTRUCTION CO Partner Mohan K Kadam, Umesh M Waje and Chandrakant S Sao, Adocate High Court, Bombay have swindled an NRI American Citizen.
Chandrakant S Sao, the main architect of the criminal conspiracy, who masterminded the entire Development Project with his family support. Builders Mohan K Kadam and Umesh M Waje --were fully aware that Mr. Chandrakant S Sao had no power to deal with the property. Chandrakant has misused my Power Of Attorney ( Strictly prohibits Divesting me of my Rights, Interest and Title and cannot Sale or Mortgage it) to vitiate my claim and swallow my property. The builders took part actively, voluntarily, and with common interest, participated jointly with my brother Chandrakant S Sao and his two sons Samir C Sao and Nilesh C Sao in this commission of criminal activity of swindling me, Ravikant S Sao, one of the owners, as I was away in the United States Of America.
When I came to know about his plan to swindle me, I initially attempted and tried to convince him the family values, via emails to give him a break in the Flat price --Market Value plus small discount. However, it did not work to his satisfaction. I was forced to cancel the POA and I sent registered letters through my Adv. Apte in Bombay to Chandrakant and the Builders. The builder, Mr Umesh M. Waje, was alarmed and got scared, obviously, as he is/was a part and parcel of the conspiracy. So he called me on May 23, 2012 at 3:07 AM in U.S. and asked me to come over to take the possession within 5 days. So I reached Bombay in three days. He took me to his attorney on May 29, 2012 and have him prepare a Registration Cancellation NOTICE to Chandrakant that the Registration has been done mistakenly in your name. In fact you are a C.A of Ravikant and in that capacity the two Flats 702 and 802 are given to you and NOT IN YOUR NAME. Also, he sent a copy to sub-registrar, Kurla 3 at the same time. On May 30, 2012 the builder gave me a letter and peaceful possession of the empty flats #702 and 802 on 7th and 8th Floor respectively, in Riddhi Siddhi Apartment, V.N. Purav Marg, Chunabhatti, Mumbai 400 022 and asked me to put locks on the Flats. His people put my name plate on the doors.
My Brother Chandrakant, although an Attorney, High Court, Bombay, was dismayed and thought his plan was foiled. So he devised a new strategy, being an Advocate, and fraudulently made a complaint in Kurla Court Case 03/N of 2012 under section S145 that I broke the lock and Trespassed. He got together with the second builder and obtained a possession letter back dated to May 25, 2012. The two builders are not in good terms. However, the main functional or active builder is Mr. Umesh M. Waje whose prime responsibility was to oversee and manage the entire project for procedural completion and attend all relevant activities as he lived about 1 kilometer from the site whereas the other builder Mr. Mohan K. Kadam has his own office in Nerul, quite far from this site.
Chandrakant asked the Police to do the Panchanama and all the police reports prepared as per the rules and factual presentation of the situation, were in my Favor and none of the clauses of S145 are satisfied. The builder has also made statements that these Flats belong to the owner Ravikant Shantaram Sao as per the registered development agreement, signed by Chandrakant himself.
All the documents are in order and explicitly indicate that I am the legal heir as per my father's WILL and owner of the two flats # 702 and 802 and Chandrakant has clearly crossed the legal boundary and committed a grossly immoral criminal act. It is reprehensible to his legal profession and for that reason he should be disbarred, and his license tp practice law should be taken away, and put behind bar. As the Supreme Court emphasized that “to keep up the professional standards it is necessary that nobody should form the impression that once a person is admitted to the legal profession he would be immune to any punitive measures and is free to indulge in nefarious or detestable activities.''

Note that Chandrakant has concealed the material fact from this Hon'ble court and used his legal bout of legal profession to misguided, misrepresented and misled the Hon'ble court. He has fraudulently obtained backdated possession letter from other builder, Mr. Mohan K. Kadam, and attached to the complaint which he could not present in the police complaint to start with, and where he showed only the Registration documents to his complaint. He has used incorrect dates and has contradicted himself in his complaint statements. The other builder, Mr. Mohan K. Kadam, dodged the police inquiry completely as he had foul played and sided with Chandrakant by giving him the backdated possession letter.
I shocked when I seen this complaint on Google. I am going to lodge complaint against this person Mr Ravikant Sao who published wrong information and who want to destroy my business credentials and my honest business's ethics. He also using our name to earn more benefit from his family dispute. I am lodging complaint with Navi Mumbai police station and filling petition in High court for fake complaint .
This issue of family and nothing have been proven by investigation by agency neither by court against us and this five brothers are fighting for more benefit than each other. Still their cases in the court against each other but neither against any FIR against us with any Enquiry Agency nor any suit against us in court. This is fake and wrong complaint against us and we decided to lodge complaint and suit against him.
