I have booked a flat in Lodha Builder’s Thane project, Casa Royale -Majestica- Flat no. 702 on 17/01/09 by paying deposit amount of Rs. 54000/-

I was introduced to Lodha group by an agent, Mr. Maanoj Menda & was
explained regarding the property by Mr. Anuj. While booking the flat,
I was told that as the flat construction is not yet started, they
won\'t be able to show actual model flat but showed us the Luxuria
flat.

As per my budget, we were advised the above mentioned flat & at no
point of time we were shown the site, neither was informed that the
deposit amount will be forfeited in case of cancellation.

After couple of days, while talking to my friend who resides in Thane,
I came to know that the site is adjacent to Crematorium Grounds, which
was shocking news for me. According to Hindu religion, it is not auspicious to reside close to ‘Samshan’, Crematory Ground. Immediately I contacted Mr. Maanoj & Mr. Anuj and requested to give me explanation. They asked me to come to the Lodha office to sort out the issue. Monday, 3rd Feb, 09, I met Mr.
Ashutosh Khatawkar, who tried to convince me that the site is good &
asked to think again, he also assured to solve my issue.

On 7th Feb, 09, I went back to Lodha office to cancel the
booking & also informed Mr. Ashutosh that it is unprofessional on
their part to not inform the buyer about Crematorium Grounds. He
advised me to shift my booking to a site which is on Ghodbunder road-
far from Thane, which I rejected. He reassured me to give solution &
next morning informed me that it is difficult to return my deposit
amount. He asked me to approach Mr. Surindra Nair to resolve the issue. I sent two mails to Mr. Nair (which went unanswered) & requested him again in one-to-one meeting with him on 15th Feb, 09. He gave me a choice to shift the booking to new site or loose the deposit amount.

On repeated requests to cancel the booking & refund the amount, he has been adamant on forfeiting of the deposit amount & asked to take whatever route I find feasible.

You will appreciate that, as a Hindu believer, I can never buy a property near Samshan. My repeated requests are going unanswered & I am terribly taken aback by the brash behavior of Lodha employees.

I was misinformed & mislead by Lodha- Thane executives and was rushed into booking the flat even without a site visit.

Please help me in getting my deposit amount of Rs. 54000/- returned.
