Your justification for enhanced Amount is on expected lines and is totally illegal.
Knowing that the Builders go for unscrupulous practices to extract more money from their client at the time when the Project is nearing completion,hence due care was taken to avoid such situation. I personally visited the Omaxe Corporate Office at Kalka Ji. New Delhi, booked the flat after clarifying all the issue related to payment.
I was informed that the Building plan are approved and there will not be any revision of Basic sale Price. I even negotiated the Price and PLC clause and it was accepted.
Building plan with dimensions was also shared. Omaxe website had also shown likely picture of Ambrosia buildings,layout plan with detailed dimensions.
It is surprising to note from your various correspondence that area has increased from 1425 sq.ft to 1646 sq. ft. due to stair case, valcony, lobby and momty etc.
Under the RERA Bill, developers can sell units only on carpet area, which means the net usable floor area of an apartment. This excludes the area covered by the external walls, areas under services shafts, exclusive balcony or verandah area and exclusive open terrace area, but includes the area covered by the internal partition walls of the apartment.
I booked the Flat in Feb-2012. and tentative completion time was end DEC-2014.
It was only during 2014, when the allotment was done and construction linked installment followed.
I have paid all installment till date ,well on time and the 10th in the series as per old schedule of Rs.2,73,353.00 has also been released on 28th.April-2017.
You have failed to complete the project as per agreed time schedule and trying to confuse your client thru. unethical practices.
I had made one thing very clear to you in my previous correspondence also that I am a Senior Citizen and my wife is a House wife. We are having a very meagre income for our livelihood. It is out of question to pay even a single Rupee more than the agreed.
As per the RERA-2016, Refund of amount in case of delay in handing over the possession has been considered.
I can go for the option to surrender the Flat and you return the entire amount with compensation and interest as provided in the RERA.
The cost of Flats in present scenario are down by 20%, whereas you are demanding approx.15% more than the earlier committed.
Pl. go thru. all the provision of the RERA 2016.
It is reiterated that the case may pl. be settled in the light of the above facts.
The last installment as per allotment letter for Rs. 2,04,820.20 (UNDUE AMOUNT) will be released before the close of the month to avoid enhanced GST .
