I applied for an apartment in pre-launch period with Ansal Housing & Construction Ltd. (herein after I refer as Ansals) on 25/12/2010 in Sector 103, Gurgaon. I lodged a complaint with facts to Ansals vide email letters dated 3/2/2012 and 24/2/2012 and subsequently sent these email letters vide my letter dated 26/3/2012 by speed post. Finding no response from Ansals, I reminded them by email letter dated 16/5/2012 and letter dated 21/5/2012 through courier, but no response has been received till date. My complaint was against the levy of interest @ 24% on late payments as penalty and further levy of 24% interest on this penalty i.e. penalty on penalty, without providing any basis or agreed upon clause to that effect. The due dates for payment of installments were to be taken with reference to booking confirmation, but no letter has been received till date to that effect. It appears to me that due dates were fixed by Ansals without any basis. Also, there is no letter of allotment / signing of agreement, though I have advanced about Rs. 30 lakhs in installments and one & half year has passed. Ansals are not taking any action to settle the dispute amicably, but demanding the penalty amount which they are compounding regularly and the same has not been paid by me so far though due installments stand paid. Recently, Ansals demanded installment which was due on the commencement of construction, which was also paid by me. Now, I came to know from Ansals website that the excavation work of only Towers N and O has started without any information of Tower P, which covers my apartment. Also, I have not received any notification regarding the commencement of the construction.

For the first time, Ansals raised the demand of interest in their letter dated 3/11/2011 and further from their account statement as on 27/1/2012, I came to know that the levy of interest @ 24% compounding quarterly started with effect from 1/5/2011, whereas there was no mention of the same in any of their letters or account statements supplied before 3/11/2011. Also, Ansals did not issue any notice in advance i.e. before 1/5/2011 about starting the levy of 24% interest.

It can be very well be concluded from the above that there is no transparency and there is a deficiency in their service as no action has been taken on my complaint and no letter of allotment / signing of agreement has been done till date.
