My name is Ajay and did my online purchase of Samsung Galaxy Note 2 N7100 Mobile Phone worth Rs 35,290/-(Order number 10340740 / Transaction Id : 10149518) on October 18, 2012 in www.timtara.com (based in Noida, UP) that is leading to Internet auction (misrepresentation or non-delivery of goods) crime.

The transaction note state that the product will be delivered within 3 weeks from the date of purchase and their customer care executive Shivali Rawat also mentioned in the sales call that the product will be delivered in 10- 12 days from the date of transaction as their are sufficient mentioned stock available. My order did not meet their 2 deadlines and the order status is still in “Awaiting Shipment” after 27days or almost 4weeks.

I have written several emails (To their CEO Arnindam Bose, Raja Singh and other custom care executive (Raja Singh , Shivali Rawat , abose@timtara.com, customerfirst@timtara.com, CCO , sakshi@timtara.com, rahul@timtara.com, bharat@timtara.com, nisha@timtara.com, mamta@timtara.com), and surprisingly there is "NO REPLY" by the senior management to my frequent emails. I also raised numerous complaints and called customer care everyday however the same response (Over call) that “it will be shipped soon”.

On the other hand, I wish to bring to your notice on this particular case where the product order delivery date commitment is not maintained by all the grievance level.

This purchase was my gift to my family for Diwali and I would lose my credentials because of their feeble sales process.

Please guide me to file a complaint for misrepresentation/non-delivery of goods under cyber crime act of e-commerce
