Northern Railway - railway not refunding unconfirmed passengers fares on etickets

I had made a eticket booking (PNR no. 2105615808) for travel for 4 persons from Kathgodam to delhi for journey on12/05/2010. After chart was prepared the 3rd and 4th persons names were not on confirmed/RAC list as displayed at the Kathgodam station that day. Hence those 2 passengers did not travel in that train. Upon return, I filed TDR with the IRCTC website and I have now been notified by them that NR has refused my claim thru their letter no. RF1/8840/10-11/B1/02.08.10/NR and the reason being 388-NR/31 Failed to collect TDR?TTE certificate.

Above reply is totally unacceptable as the passenger has not travelled as the tickets were not confirmed and hence full refund must be granted.
