Maruti Suzuki India Limited - Negligence shown by Rohan Motors

I have purchased a new Maruti Wagon-R LXI CNG car No. HR 26 BY 4390 from Rohan Motors, Suncity Business Tower, Golf Course Road, Sector-54, Gurgaon (Haryana) on 31st March 2013. Prior to this, I owned I-10 LXI car No. DL 8C S 1996, that I have sold at the show room of Rohan Motors through Rohan Motors itself on the same day under exchange scheme. I-10 car No. DL 8C S 1996 was duly insured with HDFC ERGO General Insurance Company Limited vide Policy No. 23112002553******** effective from 16-6-2012 to 15-6-2013 provided with NCB @ 45% in it.
After finalization of deal on 31-3-2013, office bearers of Rohan Motors denied to provide me the benefit of 45% NCB on the insurance of newly purchased car. Rather claimed that it will be granted to me only after obtaining NCB Certificate from HDFC ERGO General Insurance Company Limited. They also told that they will arrange the required NCB Certificate for this purpose at their own level. They also made several promises to provide best service to me as and when required and represented themselves as to be good. They further told that procurement of NCB certificate will take some time because after transfer of my old car No. DL 8C S 1996 in the name of the actual purchaser, copy of fresh RC will be required to HDFC ERGO General Insurance Company Limited to issue NCB Certificate. They promised me that as and when NCB Certificate is arranged, the excess amount paid by me will be refunded to me immediately and this entire procedure will take maximum one month.
I paid insurance premium keeping pending the benefit of NCB on the basis of assurance given by the office bearers of Rohan Motors and got my new car insured on 31-3-2013. Since then, I am under regular pursuance with Rohan Motors. I have made several personal visits, telephonic requests and have contacted with all officials up to the senior most official of Rohan Motors Gurgaon but none of them bothered to pay heed to my sincere efforts.
On 22-3-2014, Sh. Nishat Mongia and Sh. Manoj Verma AGM Sales from Rohan Motors assured me that solution of all the problems will be made on 24-3-2014 i.e. on next working day. I had been left with no option except to believe them. Since 24-3-2014, it is observed several times that both of them are ignoring and not responding to my calls. I made my all efforts and succeeded to trace out the dealer, who had purchased my old car through Rohan Motors and requested him on 26-3-2014 to provide copy of RC in the name of purchaser of my old car. The dealer provided the same on 26-3-2014 through Rohan Motors.
Now a new story is made by Sh. Nishat Mongia that benefit of NCB cannot be made to me because NCB Certificate is not issued by HDFC ERGO within 90 days. Whereas Rohan Motors is solely liable to get it provided to me in time because my old car had been sold through Rohan Motors and obviously Rohan Motors is benefitted accordingly in any manner. It is also best known to both of them as to why they were telling that NCB certificate will be obtained only after obtaining of the copy of RC, when they had known that NCB certificate issued on current dates is useless.
Due to conspiracy made by Rohan Motors, I have lost my NCB @45% including usual tax thereupon for the policy made on 31-3-2013. Further 50-20=30% NCB including usual tax thereupon is likely to be lost in policy to be made on 30-3-2014 and further loss will continue up to 6 years. Rohan Motors is solely liable for this entire loss as well as mental torture to me.
Another cause of action arose on 14-12-2013, when I submitted my car with Rohan Motors for 3rd free service. Rohan Motors only carried out washing, cleaning of air filter and changing of oil and oil filter. No other recommended task was carried out by Rohan Motors and told that they had carried out all jobs as applicable in 3rd free service. It is observed that Rohan Motors gains and earn mere for its exposure because prima facie, its working and behavior looks good but its reality exhibits at later stage. In the same way my car is not performing well after getting 3rd free service. Also on perusal of 3rd free service coupon, I came to know that tyre rotation as well as various other tasks are liable to be carried out during 3rd free service but not carried out by Rohan Motors. As such it has flouted the norms specified by Maruti Udyog Limited. Idle setting of the car is not proper and misfires during taking brakes. The situation becomes untoward during traffic jams.
In absence of proper service, it will not be suitable for me to avail extended warranty, which was advised to me and applied on my car by Rohan Motors on 31-3-2013 i.e. at the time of purchase of new car. Accordingly I want to withdraw my extended warranty from Maruti. Accordingly premium paid by me is likely to be refunded immediately along with enhancement thereupon because Maruti Dealer is not fulfilling his commitments.
Sincere and Honest office bearer of Maruti Udyog Limited is requested to initiate strong and prompt action against Rohan Motors.
