Nokia India - Mobile phone purchased from nokia was defective from day 1 and still no redress

I purchased a new nokia 2323c handset on 6.09.2009 and the handset was not getting charged and was not giving lots of problem from day1.Consequenty i approached the nokia service point at TDA complex in tinsukia assam and told them the entire thing and its nearly 5 months now but my mobile still not been replaced. Intially they told it was software problem and used to update it and return back. On 4th january they took the set and told we have to send it to Delhi but till tiday i have not got back my handset AND AFTER FEW DAYS THEY WOULD SAY IT IS WARRANTY PERIOD IS OVER.
