SUB:__Breach of Trust & bonafide belief, Nonperformance & Breach of Contract, Breach of promise and Violation of Consumer protection Laws leading to Physical & mental hardship and unwarranted financial lialibity apart from infringing the \"Basic Human Rights\"-article 10 of United Nations UDHR (impeded by Lack of Legal Counsel in O.P.No.CC/08/422-2008 before the Hon\'bleCDRF, Ernakulam, Cochin-17 ********************************************* I am a Modern Medical doctor and involved in a \"medical negligence claim\" while i was working as RMO(Resident Medical Officer) in a hospital at cochin. It is a false allegation because the claim was due to \"laches and negligence in matter of conduct of surgery for haemorrhoids (piles)\". Iam neither a surgeon, nor did i attend or assist the case in the theatre;but unfortunately i am the 4thRespondent in the suit before the CDRF, Ernakulam.The incident was on 30-01-2008.Laser surgeon and General surgeon were the concerned officers. My duty was only cosultation and ward rounds.The allegation is \"complication of surgery\". Four Opposite Parties(R1,R2,R3 &7R4) I am a member of MAPS sinse 2007. Annual fee is Rs.1000/per individual member.ihave renewed my membership in time during 2008. MAPS has the responsibility to provide indemnity cover to it\'s members in the event of litigant situations arising out of the member\'s professional duties. Every thing was going nicely, the counsel of Maps gave reply to the plaintiff\'s lawyer denying all the allegations in favour of all the FOUR oopposite parties.I got a better opportunity in a Multispeciality hospital to work in the dept. of Cardiology(Lisie Hospital, Cochin) and so i gave voluntary resignation to the MD of the institution on 06-09-2008 and joined Lisie Hospital. After Three months i received court notice form CDRF to appear before the court on 09-12-2008. When i rang up, the counsel of MAPS told me that she has direction from MAPS to represent only 1 TO 3 OPP.parties. I rang theSecretary,Maps his answer was \" YOU ASK Dr.Shajahan\"- this Dr. Shajahan is none other than the MD of the previous institution, and he was the laser surgeonwho conducted the laser surgery for the complainant and he himself, asLaser surgeon,MD and the institutoion are the other 3 opposite parties(R1,2&3). So i had no other option, but to engage my own personal lawyer at my own cost.This is the aftemath of a personal vengeance of Dr. Shajahan, but it is i who is the member of Maps and i paid the maney from my pocket. Dr. Shajahan has no role here, and Maps shouldnot have responded for such an evil deed. I am running short of time & finance to attend the case and pay fees for my counsel.Thus Maps has badly injured me through this illicit and shame full deed, even now they are not reveiling the reason behind this \"Breach of Trust & breach of Contract and violation of consumer law & Human Rights\"
