Naaptol - harassment by Naaptol

I ordered a Blackberry storm 9530 from Naaptol on 2nd of Feb 2011 after reading a advertisement in Times of India ,Pune edition, Dated 2nd Feb.
I received the product on 7th of Feb 2011 after paying Rs.12190 which include cost of the mobileRs.11990 & Rs.200 delivery charges.
After opening the packet I found that the handset was used one(second hand).It was a CDMA Handset where as it was mentioned GSM with 3G.Also the battery was scratched & software CD was missing from the package.
Immediately I called the customer service no. ********48 I informed the incident & customer service representative told me to return the product to Aramax India Pvt. Ltd.12/A, New Sun Mill Compound ,Lower Parel,Mumbai-400013, which will be replaced immediately within 7 to 10 working days.
I did the same I returned the my faulty product to above mentioned address by First flight Courier Service(AWB No.M******** dated 8th Feb 2011.).I got the confirmation for the same.
I didn’t receive anything from Naaptol after 10 working days. I called again the Customer service again, they asked me to wait for 7 to 10 working days more. I had to wait again. Once again I called up Naaptol after 7 to 10 working days on 25th Feb 2011.They gave me the received the same response stating there was some problem from their side, it will be sorted out immediately within 7 working days. This time I took the complaint no, which was 489211.There was no action from Naaptol again. I called once more & got same frustrating reply from the customer service representative.
In the mean while I wrote to their CEO (14th March) whose e-mail address was mentioned on their website & also filled up feedback form on www.naaptol.com but I am still waiting for the reply till date. I called again on 10th march. The reply was irritating .Customer service gave the same story again. No senior or manager was available to talk to me as requested by me.
On not receiving any thing I called Naaptol customer service(21st march 2011) to return my money. But he customer service representative told it is not possible to do that right now.He can only process my complain. He promised me a acknowledgment in writing to my e-mail address. No senior or manager was available to talk to me as requested by me again.
I felt that I am cheated & duped.I believe Naaptol is in business of looting & harassing innocent people. Their feedback form & CEO e-mail address on www.naaptol.com are fake because they are non-responsive ,it’s only for the show purpose.
I don’t know how a illegal company like this is allowed to do business in India. There are many complaints pending against Naaptol.
Now I am fed-up & going through mental trauma.
ButI will fight for my hard earned money.Please advise & do the justice.
Hoping a speedy action from consumer court.
I am available 24* 7 for any kind of cooperation.

I support this complaint.
a similar story is going on with me. i ahd also ordered a balckberry storm, 9530 gsm but it turned out to be cdma and locked. some 100 cals later, the issue stands to be resolved.
