Dear Sir,
I am a housewife based at Delhi.
I have to bring to your notice the gross malpractices and fraud being conducted
by the online shopping portal 100bestbuy.com. After making frustrating efforts
in trying to get my money back, which was paid in Dec 2011 back from the
site, I have finally come to your forum in the hope of an early redressal. The
entire history of e-mails is available with me. The summary of the case is
brought out below:

I had registered myself on 19 Dec 2011 on their site by paying Rs 359 and
taking part in their contest as per the scheme running at that time, the receipt
of which was acknowledged by the site. The terms and conditions (attached
separately) of the offer and their site said that if I am not the contest winner,
100% cash back will be credited to my account in the site and can be utilized
to purchase any products from their site against equivalent credit points
accrued.

From 19th Dec onwards until 24 Dec 2011, I had transferred different
amounts to the site amounting to a total of Rs 4995 which were being
reflected against my credit points by the site in my account to be redeemed
against any products purchased online.

From 24 Dec onwards until 26 May 2012, three different purchases were
made against the credits accumulated for an amount totalling Rs 1331 and
the products were received by me.

Thus, a total of credit points equivalent to Rs 3664 was left with the site until
sometime in Jul 2012, wherein it suddenly disappeared. On realizing this, I
complained to the site initially on 02 Aug and upto 7 times until 25th Sep
wherein I cautioned the site to treat it as a legal notice. 100bestbuy kept on
replying intially only in forwarding the FAQs which did not address the issue.

Subsequently, on 27 Aug, 05 Sep and 19 Sep the site replied that it was a
technical error and the problem would be addressed in 48 hours or in a period
extending upto to 5 days. It was additionally highlighted that the credit points
have validity only of three months wherein they expire. However, the T&C of
the site, contest rules, mails, etc never at any time mentioned the validity
period of the credit points. Even till date the site does not mention anything on
the validity.

After that , the site has stopped responding at all. Thus, it is pretty apparent
that the 100bestbuy team has conveniently usurped my money of Rs 3664
and does not intend to return either the credit points or my hard earned
money. Thus it is a fit case of criminal conspiracy with deliberate intention to
defraud the general public.

The entire list of mails between me and the site arranged chronologically are
available with me. A summary of the record of transactions with dates, times, order no,
amount paid, etc is collated and explained in the excel sheet attached. The link
to T&C of the contest/site is available at http://www.100bestbuy.com/tc-
contest.php.

Kindly take up the issue on your channel and caution others who may fell trap
to this racket. I hope justice may come through your program

Thanks
Pratibha Upadhyay
