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

Genesis Kitchen sink issue, most of the people is frusted because of this issue. within 20 days sink lekage problem arises. please check with engineer team about quality check.

I don’t want to disclose my name, but I want to make you aware that the sales person sitting in genesis pune project (MR. M P singh) is much cheated person. He took 3 to 4 lacks extra money per flat. Everyone is very disturbed because of him. Please get-out property junction sales team from expat group. I humbly request you.

Supreme Court judgement in various occassion is in your favour. You just stop all the cheques and give instruction to bankers. File a police complaint against the company to keeping your cheques without contract. Also file complaint in consumer court for mental agony and loss of profit in capital appreciation. Involve Rahul and agents personally.

Dear Mr. Mehta,
If you have issued the cheque to the company and the cheque has bounced the fault becomes yours. As per the laws of the country the company can do a criminal case of cheque bounce I.e. 138. It is always better to keep balance in the account and let the amount be debited. And then if the company is not giving you the plot or not refunding the money with interest you can file a case against them.
Being a lawyer I assure you that in this case the fault is yours. What I assume is that you did not have balance in your account and therefore your cheque bounced. Now you are filing a complaint because you want to save yourself from 138.

Also when you are mentioning that you had asked them not to deposit the cheque it is the companies perogative and law full right to deposit the cheque on the given date. You should have done a stop payment of the cheque.

As a legal expert I can only advise you to stay calm on this matter and save yourself from the criminal offence you have committed.
